Legal framework

This Privacy Policy is drawn up in compliance with ColombianLaw 1581 of 2012 (Personal Data Protection Act) and its implementing regulation Decree 1377 of 2013, which govern the processing of personal data in Colombia. It complements ourTerms of Service and forms part of the legal framework governing your relationship with MADELLA.

By using our Site or making a purchase, you authorise the processing of your personal data as described below.

Data we collect

We collect only the information necessary to process your orders and provide you with a personalised shopping experience:

Identification data: full name, email address, phone number.
Delivery data: postal address, city, region, and postcode.
Measurement data: sizes and body measurements you provide for made-to-measure orders.
Payment data: processed securely by our payment gateway; MADELLA does not store card details.
Browsing data: technical cookies required for the Site to function and anonymous usage analytics.

How we use your data

We use your personal data to:

Process and manage your orders and payments.
Create made-to-measure pieces according to your specifications.
Arrange shipping and keep you informed of your order status.
Handle your enquiries and customer service requests.
Send you communications about your order or, with your consent, news and collections.
Comply with legal and tax obligations applicable in Colombia.

We do not use your data for automated decision-making with legal effects or for extensive profiling.

Data retention

We retain your personal data for as long as necessary to fulfil the purposes described above and to comply with applicable legal obligations. Transaction data is retained for the period required by Colombian tax regulations (generally 5 years). Measurement data is retained while your relationship with MADELLA is active and for up to 2 years after your last purchase.

You may request deletion of your data at any time. See the "Your rights" section below.

Your rights

Under Law 1581 of 2012, you have the following rights regarding your personal data:

Access: know what personal data we hold about you and how we process it.
Correction: request the rectification of incorrect, incomplete, or outdated data.
Erasure: request deletion of your data when it is no longer necessary for the purposes for which it was collected, or when you withdraw your consent.
Portability: receive your data in a structured, commonly used format where technically feasible.
Withdrawal of consent: revoke at any time the authorisation you have given for the processing of your data.

To exercise any of these rights, write to us atinfo@madella.com with the subject line "My data rights". We will respond within a maximum of 15 business days.

International transfers

In some situations, your data may be processed by service providers based outside Colombia (for example, payment platforms or email services). In these cases, we require those providers to offer adequate data protection guarantees equivalent to those required by Colombian law, and to act only as processors in accordance with our instructions.

Changes to this policy

MADELLA may update this Privacy Policy at any time. When we make material changes, we will communicate them prominently on the Site at least 10 days in advance. Continued use of the Site after the changes are published constitutes acceptance of the updated version.
